1. Trade design use 1and1 and provide our hosted clients web space within our dedicated server/s your contention ratio is better than 20.1, in cases of web site downtime due to 1and1 we are not liable for any losses however caused
2. Trade design are not responsible for any third party programs or software ie Google mail or Google analytics or other third party programs, it is assumed by us that if asked to set theses or similar services up you will be charged
3. hosting packages , we provide standard managed hosting for clients without FTP access or unmanaged hosting with FTP access in the case of the later trade design are not responsible for any losses or errors caused by client , third party or other web developer or seo company
4. Ecommerce & data migration in some case it is required to clean tha data before import using excel & various macros this is additonal chargeable work
5. Ecommerce updates if we supply a modified cart system upgrades & all work involved past intial specified version are chargeable
6. There is no log in panel to the hosting for any user if you wish to arrange your own hosting you may do freely we can advise if it is likely to be suitable for your needs
7. Emails: if we host your emails are available at http://webmail.1and1.co.uk in most cases you may prefer to use outlook or another third party email client we are not responsible for third party email clients however we can set these up for a Fee . Emails use standard POP3 protocol
8. Moving a domain: if you change host it is normal for the domain to go offline for a period of 12-24 hours similary your domain emails will stop working. It would be prudent to back & save we are not responsible for old emails, please phone for your temporary password to gain access to the new email once your domain is live again
9. requesting domains , if we make a request to move a domain onto our server it is your responsibly to effect release and deal with the current registrar if you ask us to do this for you it is chargeable
10. SEO we offer various packages for enhancing natural traffic, for upfront payments there is no refund for monthly plans these run a rolling monthly contract we expect to be paid on the 28th of each month 1 months notice must be given for cancellation any set up fees will not refunded.
12. In all instances of agreed or contracted work you the client agree to our terms & conditions
    Trade design reserve the right to amend prices or change terms and conditions at any time this however does not affect your statutory rights

Hosting, support and updating monthly service agreements

1. Trade Design offer renewable packages of hosting and updating service agreements which can be purchased as part of a package or separately. These include hosting, content updating and search engine submissions, SEO search engine optimisation , SEM search engine marketing, PPC pay per click.
2. These packages are quoted for either on application or at time of quoting for a full project.
3. Hosting, support and updating services are annually renewable, package start dates are based on when the package or domain name is first registered and now when the web project goes live.
4. Our content update service refers to any content, photographs or text which replaces any current content. It does not extend to producing new sections or pages unless otherwise noted.
5. Customers wishing to cancel a hosting, support or updating package must inform us before the invoice date otherwise full annual payment will be required.
6. No partial refunds will be given for hosting, servicing or updating packages cancelled during the current agreements time period

 

1. The following terms and conditions apply to all web site development and hosting & general services offered by Trade Design. By accepting a quote either verbally or in writing by fax or email or any other method of communication or when ordering a product from Trade Design you are agreeing to the following terms and conditions.
2. The term Trade design or 'us' or 'we' refers to the owner of the web site whose office is 50 Brockley rise london SE231LJ. Our company registration number is ( needs update). The term 'you' 'Client' or 'end user' refers to the client.
3. It is the client’s responsibility to ensure that any web site is lawful, does not infringe any copyright or any other laws.
4. We reserve the right to refuse to construct a web site that we may judge as unfit due to content or otherwise. This includes, but is not limited by, sites containing adult oriented material such as pornography, sites which promote hatred towards persons belonging to any ethnic group, religion or sexual orientation and sites which infringe copyright or are contrary to UK laws.
5. The acceptance of a quote either verbally or in writing shall be deemed as a contractual agreement between the client and Trade Design.
6. At project acceptance Trade Design will provide an estimated completion date, however we cannot guarantee this date as a final completion date. Subsequently we are not liable for expenses or loss as a result of any delays
7. A deposit of  50% of the total quoted price must be provided & funds cleared before project commencement.  The same applies to any “white label” work as in "subcontracted"
8. Once a Job has commenced it will be completed using the information, data, text and images provided at project commencement or during the design phase. When a design has been agreed and the design or format is approved the project is moved to a development server as to facilitate viewing online
9. changes to the design post sign off are chargeable at our normal hourly fee.
10. Prior to completion the project will be presented to the client who may make any revise any content that has been supplied IE copy & images.
11. Before the project goes lives we expect full payment of any monies due whether that be quoted and or requested extra work or changes post approval of initial design this applies whether or not the client has supplied all the content or not as content or features listed in the original quote but not provided during the development phase by the client will be added at any time in the future
12. All material, both text and images, supplied by the client and used in the construction of the client's web site, will remain the client's property. All such material will be assumed to be the property of the client and free to use without fear of breach of copyright laws.
13. by supplying us with copy text or images music logos you are indemnifying us from prosecution for breach of copyright whether its is real or intellectual property rights or digital INC PRS MCPS
14. The copyright for all material provided by Trade Design, such as source code, scripts, graphics, photographs video, animation and text, will remain the property of Trade Design until such time as payment has been made in full whereupon they will become the property of the client.
15. Trade Design produce projects where every effort is made to display the pages acceptably on most popular browsers currently available, however we cannot accept responsibility for pages which don’t display properly on versions of browsers released after the project is completed
16.  The client is ultimately responsible for checking the correctness & of the site and should proof read the contents before they give trade Design the go ahead to make the site publicly available.
17. When a client agrees that a site can be made publicly available they are agreeing that the design and development of the site has satisfied all their requirements
